Description

Commercial evictions in Alabama follow a general set of steps after a tenant defaults and the landlord seeks to regain possession of the property or initiate a process that encourages the tenant to pay the outstanding rent or cure other defaults in the lease. Until 2006, commercial evictions and residential evictions followed a similar path for evictions. That year, Alabama adopted a version of the Uniform Residential Landlord Tenant Act, which now controls the steps to be taken in a residential eviction. (Ala. Code s 35-9A-101 et seq.). In addition, because residential rent is a consumer debt, provisions such as the FDCPA apply, which do not in a commercial setting. As such, this discussion will focus exclusively on commercial evictions, and any information related to residential evictions should be sought from other sources.

Ryan Daugherty is a shareholder in Dentons Sirote’s Birmingham office.  HIs practice is exclusively focused on developing solutions for clients who are involved in real estate issues and disputes. As co-chair of the firm’s landlord’s rights practice, Mr. Daugherty represents multi-family, single-family, and commercial landlords and property managers throughout Alabama on recovering possession, collecting outstanding rent, and providing outside general counsel services. His real estate litigation practice includes extensive work on cases involving contract disputes, boundary line disputes, easements, adverse possession, liens, bonds, and title issues.  Mr. Daugherty received his B.S. from Jacksonville State University and his J.D., cum laude, from Cumberland School of Law
