Representing a child presents unique problems for a criminal defense lawyer. A child is not a short adult! In a series of cases, the Supreme Court of the United States has reviewed and accepted adolescent brain development scientific studies and determined that laws apply differently to children. The majority opinions in each of these cases are fertile resources for a defense lawyer defending a child in adult court, regardless of the nature of the charge. In this presentation, we’ll review this recent line of cases. Then, we’ll discuss the science that underlies the holdings. We’ll conclude with what will hopefully be some helpful tips.

Mr. Blume received his B.S. and J.D. degrees from The University of Alabama. After law school, he served as Assistant Legal Counsel for The University of Alabama and subsequently with the corporate legal department of Southern Natural Gas Company. He entered private practice in 1984 in Tuscaloosa and practices with the firm of Blume & Blume, engaging in a general practice. Mr. Blume’s practice primarily focuses on trials and appeals of criminal defense, juvenile law, workers compensation and Social Security Disability matters. He is a frequent CLE presenter on those subjects. Mr. Blume was presented with a Merit Award by the Alabama Criminal Defense Lawyer’s Association in 2012 for “outstanding representation and performance in a criminal case.” He is a member of the Advisory Board of the Southern Juvenile Defender Center, and has participated in the “invitation only” National Juvenile Defender Center’s Leadership Summit 5 of the last 6 years. Mr. Blume was selected to chair the Alabama State Bar Task Force on Juvenile Law, Child and Adolescent Rights. He is also a member of the Louisiana State Juvenile Defender’s Office faculty for training juvenile lawyers throughout that state.
