Trust instruments are one of the most powerful tools available to elder law attorneys. There are a variety of trusts and each is important for a specific purpose. Just like working with tools in construction, it is important to use the right tool for the right job. The purpose of this presentation is to provide in-depth information on the special needs trust, which can be the most powerful tool in the belt. There are two basic types of special needs trusts, the first party instrument and the third-party instrument. Each has a unique purpose, unique features and different tax treatment.

Mr. Carney practices law in Birmingham, focusing on the areas of wills, estates, elder law and special needs planning. Mr. Carney earned his law degree from Tulane University Law School. He obtained a B.A. from the University of Alabama, majoring in Spanish and history. Mr. Carney has also earned a Chartered Life Underwriter (CLU) professional designation. Mr. Carney is a member of the Alabama State Bar and the Birmingham Bar Association.
